These Conditions, together with the Privacy Policy, govern the reciprocal relationships in relation to the use of the website and the purchase by the Customer of a Cicala service through the Cicala website or by telephone. ART. 1 - SUBJECT

A - WORK PERFORMANCE - PREMIUM ENGRAVING

The Premium Engraving Service is performed by the Cicala jewelers on the Client's instructions, therefore it can be qualified as a professional work contract and includes the manual or mechanical engraving of a jewel or watch through the use of professional equipment (eg. Laser engraving systems, pantograph). The Service is purchased online by placing it in the cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours from the order to the e-mail address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation that will be sent to the e-mail address supplied by the Customer.

 

B - PERFORMANCE OF WORK - MODIFICATION OF THE RING SIZE

The ring sizing service is performed by the Cicala jewelers on the Client's instructions, therefore it can be qualified as a professional work contract and includes the execution of a modification, through professional tools, of the structure of a ring so that it respects the size requirement requested by the Customer. The Service is purchased online by placing it in the cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours from the order to the e-mail address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation that will be sent to the e-mail address supplied by the Customer.

 

C - PERFORMANCE OF WORK - MODIFICATION OF THE RING SIZE AND ENGRAVINGS

The Service of ring size adjusting and Engraving of Rings is performed by Cicala jewelers on the Client's instructions, therefore it can be qualified as a professional work contract and includes the execution of a modification, through professional tools, of the structure of a ring. so that it meets the size requirement requested by the Customer and the execution of a manual or mechanical engraving through the use of professional equipment (eg laser engraving systems, pantograph. The Service is purchased online by placing it in the cart, and the confirmation sent by means of the 'Order Confirmation' button. D - PERFORMANCE OF WORK - CUSTOMIZATION OF NECKLACES

The Necklaces Customization Service is performed by Cicala jewelers on the Client's instructions, therefore it can be qualified as a professional work contract and includes the addition of a nickel-free 18kt white, yellow or rose gold plate to a necklace. . The Service is purchased online by placing it in the cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours from the order to the e-mail address of Cicala (support@cicala.it). E - PERFORMANCE OF INTELLECTUAL WORK - JEWELERY CONSULTING

The Jewelery Consultancy Service is performed by Cicala jewelers and consists of customer support activities: 1) in the choice of precious items; 2) in direct professional assistance to the creation of new jewels; 3) in the intervention of jewelry and goldsmiths on existing models and products. Orders are placed online by choosing the product via the 'Confirm Order' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. F - GENERAL TERMS OF SERVICE - JEWELERY REPAIR QUOTE

With the purchase of the Jewelery Repair Estimate Service, the Customer acquires only the right to receive a personalized estimate relating to the Repair Service, which will constitute, with a separate purchase of the service by the Customer, the real contract between the set off. The estimate for the repair of a jewel is professionally carried out by a Cicala jeweler at the Genoa office. The service allows you to know in detail how much it would cost to repair your jewel to bring it back to perfect condition, and does not involve further obligations for the parties. Orders are placed online with the choice of the service, the insertion of the same in the cart and the confirmation sent via the 'Order Confirmation' button. G - GENERAL TERMS OF SERVICE - WATCHES REPAIR QUOTE

With the purchase of the Watch Repair Estimate Service, the Customer acquires only the right to receive a personalized quote for the Repair Service, which will constitute, with a separate purchase of the service by the Customer, the real contract between the parties. . The estimate for the repair of a watch is carried out professionally by a Cicala jeweler / watchmaker at the headquarters in Genoa or at an authorized watchmaking laboratory in the case of watches of particular value and for which original components and spare parts were required. The service allows you to know in detail how much it would cost to repair your watch to bring it back to perfect condition, and does not involve further obligations for the parties. Orders are placed online with the choice of the service, the insertion of the same in the cart and the confirmation sent via the 'Order Confirmation' button. H - PERFORMANCE OF WORK - DESIGN E PROTOTYPING

The Design and Prototyping Service is performed by Cicala jewelers on the Client's instructions, therefore it can be qualified as a professional work contract and includes the creation of graphic drafts and / or prototypes by a Cicala jeweler following the requests provided by the Customer. The Service is purchased online by placing it in the cart, and using the 'Confirm Order' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours from the order to the e-mail address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation that will be sent to the e-mail address supplied by the Customer.

 

ART. 2 – ARCHIVING THE CONTRACT

The order form will be filed in the database of the Cicala headquarters in Genoa, Italy for the time necessary to execute it and, in any case, within the terms provided by law. The user will be able to access the order form and / or the related data through their personal account on the Cicala website. For more information see our Privacy Policy.

 

ART. 3 – PLACE OF PERFORMANCE OF THE WORK

Each work performance and intellectual work performance, the execution of estimates for the repair of jewelery and watches (points A, B, C, D, E, F, G, H) are carried out at the headquarters of the Cicala jewelry store. or at the goldsmiths' laboratories of Gioielleria Cicala, both internal and external, as well as by collaborators and professionals who, for whatever reason, carry out professional and intellectual work.

 

ART. 4 – PAYMENTS AND PRICES

Payment for the service takes place at the time of purchase on the site. Prices may be subject to change at any time, without prejudice to orders already validated by sending the order confirmation email. Prices are all checked periodically. However, should the Cicala staff find a change or an error in the price upon receipt of the Customer's order, they will contact them to verify that they still intend to proceed with the purchase by applying the correct price. In case of confirmation to this effect, the Customer is asked to remember that this does not in any case entail any obligation on the part of Cicala to provide the service (s). The prices indicated on the Cicala website at the time of check-out include all taxes (including VAT) due on the purchase of services. Payment for the service (s) must be made by credit or debit card, bank transfer in advance. Cicala accepts payments by Visa, MasterCard, American Express and Maestro cards. If Cicala is unable to accept the Customer's order for any reason, it reserves the right to choose whether to refuse the amount of the debit or credit card or to refund the sums paid with reference to the Customer's order.

 

4.1 Payments and prices of the Quote Services

Payment for the Jewelery Repair Estimate (point F) and Watch Repair Estimate (point G) services takes place at the time of purchase on the site. It includes the study of the intervention to be carried out, as well as the costs for collecting the object from the Customer as well as the costs of returning the repaired jewel to the Buyer's home. The processing (repair) of the jewel, if possible, is not included in the price of the service.

 

ART. 5 – START OF WORK, DURATION AND EXEMPTION FROM LIABILITY

The start of the work is agreed between Gioielleria Cicala and the Customer, following the signing of the online contract. Following the order, Customer Service will contact the buyer in order to collect all the useful and necessary elements to be able to proceed with the realization of the requested work and begin the execution of the work.
In case of non-cooperation of the Customer, the articles will apply. 1206 and following of the Italian Civil Code and no responsibility can be attributed to Gioielleria Cicala for the delay or failure to perform. In the cases referred to in the previous period, the price paid for the provision of the Service will be retained by Gioielleria Cicala by way of consideration for the time and material resources used by the professional to meet the unfinished request. The duration of the work is agreed with the customer, after having collected all the information useful for its determination, having regard to the complexity of the work to be carried out.

 

5.1 Obligations of the Consultant and the Client (point E)

By taking on the assignment for the jewelry consultancy service, the Consultant undertakes to remain his or her work using the diligence required by the nature of the activity carried out. The Client is obliged to make known and promptly forward to the Consultant all the documentation and information necessary for the performance of the assignment.

 

5.2 Time frame for the jewelery repair estimate (point F)

The quote is generally sent to the customer in about 10 working days. However, the timing may undergo variations, even significant ones, depending on the complexity of the jewel. Any delays with respect to the deadline agreed between the parties will be communicated to the Customer as soon as possible with an indication of a new deadline within which the quote will be sent. This new deadline, if not accepted by the customer, must be communicated at the latest within 24 hours of receiving the communication from Gioielleria Cicala.

5.2.1 Duration of the estimate

The quote is valid for 7 days from the date it was sent to the Customer by the Cicala Jewelery.

 

5.3 Timing of the watch repair estimate (Point G)

The quote is generally sent to the customer in about 15 working days. However, the timing may undergo variations, even significant ones, depending on the complexity of the watch and the timeliness of the responses from the watchmakers for the availability of the original components necessary for repair. Any delays with respect to the deadline agreed between the parties will be communicated to the Customer as soon as possible with an indication of a new deadline within which the quote will be sent. This new deadline, if not accepted by the customer, must be communicated at the latest within 24 hours of receiving the communication from Gioielleria Cicala.

5.3.1 Duration of the estimate

The quote is valid for 7 days from the date it was sent to the Customer by the Cicala Jewelery.

 

5.4 Time of realization of the design and prototyping service (point H)

Following the order, Customer Service will contact the buyer in order to collect all the useful and necessary elements to be able to proceed with the realization of the requested work and begin the execution of the work. In case of non-cooperation of the Customer, the articles will apply. 1206 and following of the Italian Civil Code and no responsibility can be attributed to Gioielleria Cicala for the delay or failure to perform. 5.4.1 Duration of the works

The duration of the work is agreed with the customer, after having collected all the information useful for its determination, having regard to the complexity of the work to be carried out

 

ART. 6 – METHOD OF EXECUTION OF THE WORK

The Loan undertakes to carry out and complete the work with diligence, professionalism and state of the art. The Customer can always ask for updates on the execution and its progress by making a request directly to: support@cicala.it.

 

6.1 How to carry out the premium engraving service (point A), the ring sizing service (point B), the ring sizing and engraving service (point C), the necklaces customization service (point D)

The Service Provider, before starting the execution of the work, sends the customer a detailed e-mail and / or a graphic draft of the work ordered. Only after having collected the customer's consent to continue the work, Gioielleria Cicala will start the commissioned work.

 

6.2 Methods of execution of the design and prototyping service (point H)

The Provider, with this service, undertakes to create the graphic prototype of the product requested by the customer. The service does not include the creation of the jewel, or the actual goldsmith intervention, which must be regulated and purchased with a separate contract. The customer can always ask for updates by writing directly to: support@cicala.it.

 

ART. 7 – CHANGES IN PROGRESS

The Service Provider undertakes to promptly and in advance notify the Customer of any further work that may become necessary for the correct execution of the work during the execution of the work compared to those estimated, as described in points A, B, C, D, E, F, G, H (Object of the contract ") of these General Terms & Conditions of work performance (Service).

 

The communication, including the cost of the new work and any new delivery date, must be expressly accepted in writing by the Customer. If the Customer accepts the new conditions, they will be valid against Cicala Jewelery notwithstanding the original agreement on the price and object of the work.

 

ART. 8 – ACCEPTANCE OF THE WORK AND DIFFORMITY

Once the work has been completed, following collection at the store or delivery to his hands, the Customer must proceed to verify the same in order to carry out the acceptance or to detect any defects or discrepancies with respect to what he seen and accepted at the start of the works.
The express or tacit acceptance of the work by the Customer frees the lender from liability for discrepancies or defects if these were known to the Customer or if they could be easily recognized by the same, provided they are not maliciously concealed. The Customer must, under penalty of forfeiture, report the discrepancies and defects to Gioielleria Cicala within eight days of discovery by registered letter or by electronic communication sent to the address: support@cicala.it.

These conditions (6. Acceptance of the work and discrepancies) are not applicable to the services E (jewelery consultancy), F (jewelery repair estimate), G (watch repair estimate), H (design and prototyping) of this contract .

 

ART. 9 – EXCLUSION OF THE CUSTOMER'S RIGHT OF WITHDRAWAL FROM THE CONTRACT

Pursuant to art. 59 of the Consumer Code, the provision of work for the production of products on request does not make the rules on the right of withdrawal applicable.

 

ART. 10 – IMPOSSIBILITY OF THE EXECUTION OF THE WORK

If the execution of the work becomes impossible for reasons not attributable to any of the parties, the Service Provider is entitled to compensation for the work performed in relation to the usefulness of the part of the completed work. This amount is assessed from time to time at the discretion of the parties.

 

ART. 11 – COMPLAINTS

Any complaints must be sent by registered letter with return receipt. to Cicala and advance, if possible, by e-mail to reclami@cicala.it with the subject: "Complaint" followed by the purchase order number.

 

ART. 12 – DISPUTES

For any dispute between the parties regarding this contract, the Court in whose district the consumer has his domicile or residence will be competent, according to current legislation, provided that this place is located within the Italian Republic.

12.1 Joint conciliation procedure

Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he or she may submit a complaint via the ODR platform of the European Union which can be reached by clicking on the following link ec.europa.eu/consumers/odr/. According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can make use of the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after submitting a complaint to the company, has not received a response within 45 days or has received a response that is not deemed satisfactory by him. ART. 13 – FINAL CLAUSES

These Terms of Service and any other document expressly referred to in them constitute the entire agreement between the parties with reference to the subject of the Contract. The Agreement and any further communication between the parties will be formulated in Italian. The form, existence, construction, execution, validity and any other aspect of these Terms of Service or any of the clauses contained therein are governed by Italian law.

 

ART. 14 – CODE OF CONDUCT

Cicala.it adheres to the guidelines of the Ecommerce Europe Code of Conduct, has obtained the trustability logo and declares its commitment to constant compliance with the sector regulations.
