1 - Conditions of Sale
1.1. Cicala recommends carefully reading these Terms of Sale before ordering products on its website. These Terms of Sale, together with the Privacy Policy, govern the mutual relationship regarding the use of the website and the purchase of a Cicala product by the Customer through the Cicala website or by telephone. For any questions regarding these conditions, or if the Customer does not intend to accept their application, please contact Customer Service at support@cicala.it before proceeding. The following information is provided pursuant to Article 49 of the Consumer Code and subsequent articles (Legislative Decree no. 206 of 6 September 2005).
1.2. By clicking the "Confirm Order" button on the website during the final purchase process, the Customer declares acceptance of these Conditions of Sale. Please note that if you do not accept these Conditions of Sale, you will not be able to purchase any products on the Cicala website.
2 - Order entry and confirmation process
2.1. To purchase on the www.cicala.it portal, follow the steps below:

β Add the product to the cart;
β Confirm your cart by clicking Proceed with Order or View Cart. You can adjust quantities or delete items by continuing to checkout;
β Enter your details, shipping method and payment method;
β View the total, including taxes and shipping costs (if applicable);
β Accept the general conditions of sale;
β Confirm your order by clicking the "CONFIRM AND PAY" button, which is equivalent to sending a commercial purchase proposal.
2.2. By submitting the order proposal, the Customer confirms their intention to purchase on the Cicala Srl website, but the order will be definitively concluded only when Cicala Jewellery sends written confirmation, notifying the buyer via the registered email address or indicated in the order details.
2.3. Since the items offered by Cicala are also available for sale in physical stores, the selected jewelry may not be immediately available. In this case, Cicala will inform the Customer of the exact delivery time before accepting the purchase.
2.4. For orders that require additional steps after placing a purchase in the cart (for example, preparing a prototype, sending reservations to suppliers, etc.), Gioielleria Cicala will send a confirmation of order acceptance, which will be followed by a final confirmation a few days later, followed by an indication of the order fulfillment time.
2.5. Once orders have been submitted, they cannot be modified or cancelled by the buyer. Any errors or cancellation requests must be reported without undue delay and no later than 24 hours after placing an order by email to Cicala Jewelers (support@cicala.it). In such cases, Cicala Jewelers will decide at its sole discretion.
3 - Contract archiving and access to order history
3.1. The purchase contract will be stored in the database of Cicala's headquarters in Genoa (GE), at Via Martiri della Libertà, 23-25r - 16156 Genoa, Italy, for the time necessary to process the order and for administrative purposes as required by law. Users may access their data and order history through their personal account on the Cicala website. For more information, please see our Privacy Policy.
4 - Products and prices
4.1. Cicala sells only original items. All products are accompanied by official boxes and guarantees from the respective companies and manufacturers. The prices listed on the product pages on the site include VAT and are the manufacturers' recommended list prices, which Cicala uses to display the products in its physical stores. The final price, including shipping costs, insurance, and any customs duties, will be clearly displayed before final order confirmation. Any customs duties for shipments outside the European Union are excluded.
4.1.1 - BRAND LICENSES
Cicala does not necessarily hold the status of an official licensee of all the brands offered for sale and therefore does not maintain direct commercial relationships with all the companies that own the brands. Cicala, in any case, always guarantees the absolute originality, lawful origin, and perfect integrity of the products sold, which are always accompanied by their official packaging (box and guarantee).
4.1.2 - VINTAGE JEWELRY AND WATCHES
Cicala enriches its customer offerings with vintage, or at least not new, or collectible jewelry and watches that combine exceptional quality with a guaranteed affordable price. The general characteristics of these products are always clearly specified: the material, the condition in which they are sold, and the warranty provided. For each product, carefully selected, inspected, and possibly restored, Cicala issues a certificate of legitimate origin with a guarantee of authenticity. For all items of this type, the warranty is accompanied by photographs that portray and highlight even the smallest details.
4.1.3 - PROMOTIONS AND DISCOUNTS
Cicala rewards its loyal customers with truly advantageous discounts. A first significant discount can be obtained free of charge and with no obligation to purchase by registering on Cicala and subscribing to the newsletter. Other discounts and promotions will be available, exclusively for members, throughout the year. All products on promotion are not subject to further discounts and/or promotions.
4.1.4 – PRODUCT PHOTOGRAPHS
Cicala independently takes photographs of its jewelry for sale on the website: all images of the jewelry accurately represent the final jewel that the Customer can purchase. Watches and jewelry produced by brands are offered for sale using the official images provided by the respective manufacturing brands.
Some items may appear slightly larger or smaller than the actual size of the item in order to adapt the item to the screen or due to particular photographic techniques. Other items may be depicted in a larger size than the actual one in order to clearly show the details, or smaller than the actual size in order to show the entire item. Cicala will always try to provide all useful information to determine the size of the product.
4.1.5 – PRICE ALIGNMENT REQUEST
Cicala is committed to offering its customers transparent and competitive purchasing conditions. If a customer finds that a product listed on the website www.cicala.it is available, at the time of purchase, from an authorized Italian retailer at a lower, publicly visible and verifiable price, they may request a price adjustment before finalizing the order. To submit such a request, they must complete the appropriate online form on the product page or promptly contact Customer Service at +39 0106981030, providing:
β a clear and complete description of the product;
β name and company name of the competing authorized dealer;
β full advertised price, including VAT and delivery terms;
β proof of actual product availability with estimated delivery within 2-3 business days (e.g. dated screenshot or direct link).
Price match requests are assessed individually by our staff, who reserve the right to approve or reject them without stating a reason. Matching applies exclusively to new, identical products, with official packaging and manufacturer's warranty, and sold by officially authorized resellers in Italy. Requests based on offers from unauthorized parties, non-public promotional sales, auctions, used, second-hand, or refurbished products will not be considered valid. Customers are advised to carefully verify the source of the compared offer.
5 - Sale of used products, valuable goods and customer identification obligations
5.1. SCOPE OF APPLICATION AND NATURE OF THE GOODS
This section governs the specific conditions applicable to the sale of used, second-hand or collectible products, including, but not limited to:
β second-hand watches in steel and/or precious metals;
β vintage or used jewelry in gold, silver or other precious materials;
β investment gold (bullion and coins);
β collectible coins and numismatic goods.
These goods fall into product categories subject to specific legal obligations regarding purchaser identification, transaction traceability, and money laundering prevention, pursuant to current legislation.
5.2. LEGAL IDENTIFICATION OBLIGATION
Pursuant to Legislative Decree 231/2007 and subsequent amendments, as well as the regulations applicable to the trade of precious, used, or highly valuable goods, Cicala is legally required to identify the buyer before proceeding with the delivery or shipment of the goods. Therefore, the buyer's identification constitutes:
β essential and mandatory condition for the conclusion of the sales contract;
β mandatory prerequisite for the delivery of the goods;
β non-waivable legal obligation, not dependent on Cicala's commercial choices.
In the absence of valid and completed identification, the sale cannot be completed.
5.3. IDENTIFICATION METHODS
The identification of the buyer can take place alternatively:
1. In person, at one of Cicala's physical stores, upon presentation of a valid identity document;
2. Remotely, through a digital recognition procedure, carried out through systems compliant with current legislation, which provide for:
1. using a valid identity document (Electronic Identity Card, passport, or driving license for Italian residents);
2. an identity verification process, including biometrics, where provided for by the system used.
The digital identification procedure is initiated exclusively after verification of the payment credit, as indicated in the following paragraphs.
5.4. PAYMENT, PRODUCT RESERVATION AND TIME TERMS
For online purchases of the goods referred to in this section, payment is accepted exclusively by bank transfer made out to Cicala.
Cicala's sending of the order confirmation constitutes a temporary reservation of the product, lasting a maximum of 24 (twenty-four) hours, and does not constitute definitive acceptance of the order or conclusion of the sales contract.
Within this 24-hour period:
β the Customer is required to arrange payment of the amount due;
β Cicala must receive the actual credit of the amount or, alternatively, a payment slip proving the transfer has been made.
5.5. Failure to pay within the terms and cancellation of the order
If, within 24 hours of order confirmation:
β the payment has not been credited;
β nor has suitable proof been provided that the transfer has been made,
the order will be automatically cancelled, without the need for further communication, and the product will be put back on sale.
In this case:
β the Customer will not be able to claim any right on the booked goods;
β Cicala cannot be held responsible for any subsequent unavailability of the product.
5.6. STARTING THE DIGITAL RECOGNITION PROCEDURE
Only after verifying the payment will Cicala send the Customer a dedicated link to complete the remote identification procedure.
The Customer is required to:
β complete the recognition procedure correctly and truthfully;
β provide authentic, valid data and documents attributable to oneself.
Failure to complete the identification process within 48 hours of sending the dedicated link, or refusal or failure to complete the process, will result in the inability to deliver the goods and will entitle Cicala to terminate the contract, in accordance with the procedures established by law.
5.7. CONSEQUENCES OF FAILURE TO IDENTIFY
In case of:
β inability to identify the Customer;
β negative outcome of the recognition procedure;
β inconsistencies or irregularities in the data provided;
Cicala reserves the right to:
β do not proceed with the shipment or delivery of the goods;
β terminate the sales contract;
β return any amount collected, net of any administrative costs permitted by law, if applicable.
It is understood that these measures are adopted in compliance with regulatory obligations and do not constitute a breach of contract by Cicala.
5.8. PROCESSING OF PERSONAL DATA
Personal data collected for identification purposes are processed exclusively to fulfill legal obligations, in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation, as indicated in the Privacy Policy available on the website.
6 – Legal Guarantee
6.1. All items for sale on Cicala are guaranteed to comply with the specifications listed in the published product sheets and are always accompanied by the original warranty and packaging, if provided by the manufacturing companies. The warranty may be asserted by the Customer within 24 months of delivery, provided that the defect is reported within 60 (sixty) days of its discovery.
6.2. In the event of a lack of conformity of the products, pursuant to the Consumer Code, the Customer has the right to have the conformity of the goods restored, free of charge, through repair or replacement.
6.3. If it is impossible to pursue the above remedies, the Customer has the right to an appropriate reduction in the price of the products or to terminate the contract. These rights are deemed waived if any lack of conformity is not reported within two months (sixty days) of its discovery.
6.4. WARRANTY ON WATCHES
Watches sold by Cicala, with the exception of pre-owned (used) watches, are guaranteed for a period of 24 (twenty-four) months from the date of purchase in accordance with the warranty conditions. High-quality watches are guaranteed for 60 (sixty) months from the date of purchase in accordance with the warranty conditions. The international warranty covers any defects in the materials from which the watch was constructed, as well as manufacturing defects existing at the time the watch was sold. During the warranty period, upon presentation of a valid warranty certificate (i.e., a certificate bearing the date of purchase, correctly completed and stamped by Cicala), the Customer will have the right to have their watch repaired free of charge by the manufacturer. If the repairs are inadequate to restore the watch to its normal condition, the manufacturer will replace the timepiece with a new watch with identical or similar characteristics. The manufacturer's obligation to replace the watch ends 24 (twenty-four) months from the date of purchase of the replaced watch. After this period, Cicala will offer the customer alternative solutions to allow them to exercise their warranty rights. The warranty can only be activated if the warranty certificate included with the watch at the time of purchase is dated, duly completed, and stamped by Cicala. Upon receipt of their purchase, the customer is required to verify that the warranty contains all the necessary details for its validation and, if necessary, contact Cicala Jewelry as soon as possible to request the completion of any missing information. The warranty does not cover: battery life; damage resulting from wear and tear and aging (such as scratches on the glass, alterations in the color and/or material of non-metallic bracelets and straps made of leather, fabric, or rubber, and the fading of plating); Any damage to any part of the watch resulting from abnormal or unauthorized use of the watch, lack of due care, negligence, accidents (knocks, dents, impacts, broken glass, etc.), incorrect use of the watch, or failure to follow the manufacturer's instructions; any indirect damage of any kind resulting, for example, from use, malfunction, defects, or lack of accuracy of the watch; repairs to the watch performed by unauthorized persons (such as during battery changes, repairs, or service), or alterations to the watch from its original condition without the manufacturer's supervision.
6.5. - JEWELRY WARRANTY
All jewelry will be provided with a descriptive certificate regarding the gemstones and the fineness of the metal and/or precious materials used. The warranty does not cover damage resulting from wear and tear and aging (such as scratches, discoloration, and the fading of plating); any damage to any part of the jewelry resulting from abnormal use, lack of due care, negligence, accidents (knocks, dents, impacts, etc.), or incorrect use of the jewelry; any indirect damage of any kind resulting from use; repairs to the jewelry(s) performed by third parties, or alterations to the jewelry(s) from its original condition without the supervision of the manufacturer.
7 - Insurance policy for theft, pickpocketing, robbery and fire
7.1. For certain particularly delicate or expensive products, or for other reasons at the sole discretion of Cicala Jewelers, the seller may issue a free one-year insurance policy against theft, pickpocketing, robbery, and fire.
8 – Payments
8.1. Product prices are displayed both on the product page and during the checkout process. Prices are subject to change at any time, except for orders already confirmed by email confirmation of shipment.
8.2. Prices are checked periodically. However, if Cicala staff discovers a pricing error upon receiving the customer's order, Cicala Jewelers will contact the customer to verify that they still wish to proceed with the purchase at the correct price. In this case, Cicala will send confirmation of the contract conclusion with the correct prices.
8.3. Payment for the product(s) can be made using any method available to the customer at checkout, including: credit or debit card, advance bank transfer, payment by installments via PagoLight, Klarna, or Findomestic, PayPal, or deposit payments. Cicala accepts Visa, Visa Electron, MasterCard, American Express, and Maestro cards. Other payment methods must be agreed upon on a case-by-case basis.
8.4. No shipment of the product(s) will be made until full payment has been received.
8.5. Cicala Jewellery is not responsible for any delay or failure to deliver the product(s) ordered if the card issuer or our service provider refuses or does not authorize or validate the payment for any reason.
9 - Shipping and transport
9.1. All products sold are shipped with free insurance coverage for the Customer, paid for by Cicala. For purchases over €100.00, shipping to Italy is free. All products for sale on Cicala and immediately available (Available Now) are shipped within 1-3 business days.
Excepted are products that are not in stock and must be ordered from a supplier (Available to Order) or that require additional processing, such as name engraving or ring sizing. In these cases, delivery times will be estimated and communicated on a case-by-case basis depending on the processing required.
9.2. Shipping will be via Bartolini, DHL, or another carrier chosen by Cicala Jewelers, and will always be traceable by the Customer (the Customer will be provided with a tracking code to the email address used for purchase).
9.3. Ordered products will be shipped to the address indicated by the Customer. Cicala cannot be held responsible for any delays or non-delivery due to unforeseeable circumstances or force majeure, nor for delays attributable to the carrier.
9.4. The product will be shipped accompanied by a purchase receipt, any receipt (in the case of purchases made with advance payment and immediate credit of the amount), and any invoice in the name of the buyer (if the Customer has provided the necessary information and explicitly requested it during the purchase process).
9.5. You can choose between two different shipping and delivery options, including on-site pickup. Each option has the following applicable costs:
β Standard (Italy): Delivery to the indicated address usually takes 1 to 3 business days. Delivery can therefore take place between 8:00 AM and 6:00 PM the following day for products in stock (Available Now). Standard shipping is free in Italy for purchases of €100 or more, while for purchases up to €99, a €6 shipping fee is required.
β Standard (Worldwide): Delivery to your address may take 2 to 5 business days for in-stock products. Shipping costs vary depending on the destination country; entering your delivery information will display the correct amount to pay before confirming your purchase.
β Premium: Speed up and prioritize your order: Cicala Jewelers' staff processes purchases made with Premium Shipping first. Delivery can take 24-48 hours, between 8:00 AM and 6:00 PM, for in-stock products (Available Now). An additional €10 is added to the Standard Shipping cost. This shipping option is recommended for those with very close delivery dates.
β In-store pickup: free. Customers can choose to pick up their purchase at one of Cicala's stores. Customers will be notified via SMS, email, or phone if the order is available for pickup at their preferred location. Orders are usually available for pickup starting at 10:00 a.m. the day after purchase.
9.6. All products for sale on www.cicala.it, if immediately available with the wording Available Now, are usually shipped and delivered within 1-3 working days, except for the exceptions indicated in the Notes* below.
9.7. For products Available to Order (i.e., to be ordered from a supplier, created, or for which additional processing is required, such as name engraving or ring sizing). The delivery time in these cases varies depending on the product's return to stock or the complexity of the requested processing. The estimated time for restocking the product can be viewed next to the "Available to Order" wording for products to be ordered from a supplier.
9.8. The shipping times indicated refer to normal business periods: during public holidays and other holidays in general, delivery times may vary. If delivery dates are close to the time of purchase, the Customer is invited to contact Customer Service for any information.
*Note:
For Southern Italy, islands, and remote areas (historic centers, areas not reachable by ordinary urban traffic), delivery times may take 1-3 additional days depending on the destination. To ensure the quality and efficiency of the service, we ask customers to carefully enter their complete shipping address, along with any notes to facilitate delivery (e.g., preferred times).
For European Union countries, shipping times are 1-3 working days and costs are expressed on a case-by-case basis during the purchase phase depending on the destination country.
For non-EU countries, shipping times are usually 2-5 business days, excluding any customs clearance time. Shipping costs are clearly indicated during the checkout process, depending on the destination country; any customs charges are always the customer's responsibility.
Delivery dates may be postponed due to inclement weather, natural disasters, strikes, or other events that may cause the interruption or extension of shipping times. Orders shipped abroad may experience delays due to customs inspections. Cicala Jewelry cannot be held liable under any circumstances for any delays or failures in delivery due to unforeseeable circumstances or force majeure, nor for delays attributable to the carrier. Understanding the importance of timely delivery of orders, Cicala is committed, through its Customer Service, to assist and support customers in the event of delivery delays.
10 – Damaged products
10.1. Except in cases of lack of conformity or functionality, for which the legal guarantee applies to the Customer, upon delivery of the package the Customer is required to inspect the product(s) in order to verify the presence of any evident and visible (obvious) defects or damage.
10.2. If the Customer finds any defects or damage, he or she must report it to Cicala as soon as possible and in any case within 7 days, attaching evidence of the damage (photographs or videos).
10.3. Once the damage has been ascertained, Cicala will arrange for the collection or return of the item in question to its premises, at no cost to the Customer.
10.4. Before issuing a refund for the item, Cicala will conduct appropriate checks to determine the source of the damage. These checks take a maximum of 7 days.
10.5. If it is found that the damage to the product(s) occurred before delivery, or that the defect is not attributable to the fault or use of the Customer, Cicala will repair or replace the product(s) or refund the full price paid by the Customer, including any shipping costs, provided that the damage does not result from having worn or used the product(s).
10.6. If the Customer prefers repair or replacement of the product(s), please contact Cicala, who will replace the item at no additional cost where reasonably possible. Additionally, Cicala will reimburse the costs incurred for returning the item.
10.7. In the event that Cicala suspects that the damage is attributable to incorrect handling of the jewel by the Customer or to accidental falls presumably occurring under the control of the customer, it may carry out appraisals on the item before giving the Customer a response regarding the possibility of a refund.
10.8. If it is found that the damage to the product(s) occurred after delivery, the goods will be returned to the Customer by Express Courier and no refund will be due.
11 - Right of withdrawal
11.1. Pursuant to Article 52 of the Consumer Code, the Customer has the right to withdraw from this Agreement without stating any reason within 14 calendar days of delivery of the order.
To exercise the right of withdrawal, the Customer may follow the instructions contained within the package (if the purchase is covered by the right of withdrawal) and is required to provide unequivocal written notification in the following alternative ways:
β Registered mail with return receipt to Cicala Srl, Via Martiri della Libertà, 23r – 16156 Genoa (Italy);
β By email to support@cicala.it (specifying your full name, address, telephone number, and order number);
β By completing the appropriate withdrawal form included in the package (if the purchase is covered by the right of withdrawal) and sending it to the addresses above;
β By following the automatic procedure found in the order details on your user profile page (if the purchase is covered by the right of withdrawal).
11.2. After communicating the intention to exercise the right of withdrawal, the Customer must return the products promptly and in any case within 14 days of the communication of withdrawal to Cicala, sending them in the same condition in which they were delivered.
11.3. The Customer is required to exercise due diligence in caring for the product(s) in his/her possession. The product must be returned in perfect condition, in its original packaging and complete with all accessories provided at the time of purchase (warranty, case, instructions, etc.), together with the purchase document. This does not apply to any products available on request (ordered from a supplier), customized, modified, or created to order; for these products, any refund or return is void. The Customer is also invited to send photographs of the product to be returned in advance to verify its good condition.
11.4. Before proceeding with the shipment, Cicala recommends agreeing on the return procedure with Customer Service (available Tuesday to Saturday from 9:00 to 12:30 and from 15:30 to 19:30 at the contact details indicated above).
11.5. The Customer may return the item using any courier or post office, choosing the method of transport he or she prefers, and assuming the risk of loss and related costs.
11.6. The cost of return shipping is always borne by the buyer, in the amount of 12 euros.
12 - Exclusions from the right of withdrawal
12.1. Products may not be returned to Cicala in the cases referred to in Article 59 of the Consumer Code, such as the purchase of specially customized, engraved, or custom-ordered products; the supply of sealed items that are not returnable for health or hygiene reasons, where the seals have been removed after delivery, etc. Cicala verifies the conformity of all returned products, including through photographic and video inspection if necessary. If the product has been used or altered from its original condition, Cicala reserves the right to refuse the return or, alternatively, reduce the refund amount accordingly. If, after carrying out these checks, Cicala decides not to accept the return, it will notify the Customer, specifically informing them of the reasons why the return cannot be accepted.
12.2. Recipients of gifts purchased on Cicala.it, but not buyers, are entitled to product exchanges but not refunds unless requested by the person (the Customer) who placed the order. To request a product exchange or refund from the buyer (Customer), please follow the instructions provided inside the package shipped by Cicala.
12.3 Upon notification of non-acceptance of the return, if the Customer has already shipped the return, Cicala reserves the right to refuse the package. However, if the return package, and therefore the purchased products, have already been collected by Cicala, the Customer will be provided with information for collecting, at their own expense, any products not subject to the right of withdrawal, return, or exchange.
13 – Refund following the exercise of the right of withdrawal
13.1. If the product(s) are returned according to the terms indicated, Cicala will refund the full price of the product(s), except for any deductions due to use and damage to the product, as well as the standard shipping costs incurred by Cicala.
13.2. Cicala will refund the amount using the same payment method used by the Customer, or by bank transfer, within 14 days of receiving the goods for which the right of withdrawal was exercised.
13.3. In the event of anomalies in the received package (damage to the jewelry not contested by the Customer, replacement of the product or gemstones, or other product anomalies), the refund period may be suspended or extended until the appropriate checks are completed, with appropriate and timely justification provided by Cicala. In this case, the Customer will be notified by email or telephone.
14 – Complaints
14.1. Any complaints must be sent by registered mail to Cicala and, if possible, sent in advance by email to reclami@cicala.it with the subject line 'Complaint' followed by the purchase order number.
15 – Disputes and dispute resolution
15.1. Any dispute between the parties regarding this contract will be subject to the jurisdiction of the court in whose district the consumer is domiciled or resident, provided that such place is located within the Italian Republic. Otherwise, the jurisdiction established by international law will apply.
15.2. Pursuant to Article 14 of Regulation 524/2013, users are informed that in the event of a dispute, they may submit a complaint through the European Union's Online Dispute Resolution (ODR) platform, accessible by clicking the following link: http://ec.europa.eu/consumers/odr/. The Online Dispute Resolution (ODR) platform provides a gateway for users wishing to resolve disputes arising from online sales or service contracts out of court. For further information, please contact: reclami@cicala.it.
15.3. The Customer may avail of the Consumer Joint Conciliation procedure provided by the Netcomm Consortium, of which Cicala is a member. The procedure may be initiated if the consumer, after submitting a complaint to the company within 45 days, has not received a response or has received a response that is not deemed satisfactory.
15.4. Customers who choose to use the Joint Conciliation procedure must submit their request to conciliazione@consorzionetcomm.it or directly to the Consorzio Netcomm website, http://www.consorzionetcomm.it/Spazio_Consumatori/Conciliazione-Paritetica/La-Conciliazione-Paritetica.kl
16 – Final provisions
16.1. These Conditions of Sale and any other document expressly referred to therein constitute the entire agreement between the parties with reference to the subject matter of the Contract.
16.2. Any further communication between the parties will be formulated in Italian.
16.3. The form, existence, construction, execution, validity and all other aspects of these Conditions of Sale or any of the clauses contained therein are governed by Italian law.
16.4. The Customer may print a copy of these conditions and keep it for his/her records.
