GENERAL TERMS & CONDITIONS OF SALE

 

Introduction

Cicala recommends that you carefully read these Conditions of Sale before ordering the products on its website. These Conditions, together with the Privacy Policy, govern the reciprocal relationships in relation to the use of the website and the purchase by the Customer of a Cicala product through the Cicala website or by telephone. For any questions regarding these conditions, or if the Customer does not intend to accept their application, it is possible to contact Customer Service at the email address support@cicala.it or at the toll-free number 800 865 648 (from a fixed network in Italy) or 0039 010 6981030 before proceeding further. The following information is provided in accordance with Article 49 of the Consumer Code (Legislative Decree 6 September 2005, no. 206).

By clicking on the "Confirm Order" button on the website during the final purchase phase, the Customer declares to accept these Conditions of Sale. Please note that, in the event of non-acceptance of these Conditions of Sale, it will not be possible to purchase any product on the Cicala website.

 

1 - CONDITIONS OF SALE

Orders are placed online by choosing the product via the 'Confirm Order' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours from the order to the e-mail address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation that will be sent to the e-mail address supplied by the Customer.

 

The product will be shipped accompanied by the purchase receipt, any receipt (if necessary for the validation of the guarantees) and any invoice made out to the buyer (if the customer has provided his tax code and made an explicit request during the purchase).

 

Since the items offered by Cicala are also on sale in physical stores, the selected jewel may not be immediately available. In this case, Cicala will be responsible for informing the Customer of the exact delivery time before accepting the purchase.

 

1.1 - CONCLUSION OF THE CONTRACT

The order form will be filed in the database of the Cicala headquarters in Genoa, Italy for the time necessary to execute it and, in any case, within the terms provided by law. The user will be able to access the order form and / or the related data through their personal account on the Cicala website. For more information see our Privacy Policy.

 

2 - PRODUCTS AND PRICES

Only original items are on sale on Cicala. All the products offered are accompanied by boxes and official guarantees of the respective companies and manufacturers. The prices shown in the product sheets on the site are inclusive of VAT and are the normal list prices recommended by the manufacturers and with which Cicala exhibits the products in its physical stores. The final price including shipping costs, insurance and any customs charges will be highlighted and clearly visible before the final order confirmation. Any customs duties for shipments outside the European Union are excluded.

 

2.1 - BRAND CONCESSIONS

Cicala does not necessarily hold the status of official dealer of all the brands offered for sale, and therefore does not have direct commercial relationships with all the companies that own the brands. In any case, Cicala always guarantees the absolute originality, the lawful origin and the perfect integrity of the products marketed, which are always accompanied by their official kit (box and guarantee).

 

2.2 - VINTAGE JEWELS AND WATCHES

Cicala enriches the proposals intended for its customers with vintage jewelry and watches, or in any case not new, or collectible, and which have characteristics of exceptional quality combined with a price of sure convenience and occasion. For these products the general characteristics are always well specified: the material, the conditions in which it is sold and the guarantee issued. For each product, rigorously selected, checked and possibly restored, Cicala issues a certificate of lawful origin with a guarantee of originality and functioning for 24 months. For all items of this type, the guarantee is accompanied by photographs that portray and highlight even the smallest details.

 

2.3 - PROMOTIONS AND DISCOUNTS

Cicala rewards its loyal customers with really advantageous special treatments. A first significant discount can be obtained free of charge and without obligation to purchase by registering on Cicala and subscribing to the newsletter. Other discounts and promotions will be available, exclusively for members, during various periods of the year. All products placed in promotion are not subject to further discounts and / or promotions.

 

2.4 - PHOTOGRAPHS OF THE PRODUCTS

Cicala independently creates the photographs of its jewels offered for sale on the website: all the images of the jewels represent exactly the final jewel that the customer can buy. The watches and jewels produced by brands are offered for sale using the official images provided by the respective manufacturer brands.

Some objects may appear slightly larger or smaller than the actual size of the object in order to adapt the object to the screen or due to particular photographic techniques. Other items may be pictured in a larger size than the actual size in order to show the details clearly, or smaller than the actual size in order to show the full item. Cicala will always try to provide any useful information to determine the size of the product.

 

2.5 - DAMAGED AND DEFECTIVE PRODUCTS

Upon delivery of the package, the Customer is required to inspect the product (s) in order to check for any defects or damage. If the Customer finds the presence of defects or damages, he must report it as soon as possible and Cicala will arrange for the relative return to its headquarters, at no cost by the Customer.

 

If it is ascertained that the damage to the product (s) occurred before delivery, or that the defect is not attributable to fault or use by the Customer, Cicala will provide for the relative repair or replacement or full refund of the price paid by the Customer, including any shipping costs, provided that the damage does not derive from having worn or used the product (s).

 

If the Customer prefers the repair or replacement of the product (s), please contact Cicala who will replace the item at no additional cost where this is reasonably possible. In addition, it will reimburse you for the costs incurred for returning the item. In the event of a lack of conformity of the products pursuant to Article 129 of the Consumer Code, the legal guarantees referred to in Articles 129 et seq. of the Consumer Code. The Customer has the right to restore, without charge, the conformity of the goods by repair or replacement. If it is impossible to carry out the above remedies, the Customer has the right to an adequate reduction in the price of the products, or to terminate the contract. These rights are understood as waived if any lack of conformity is not notified within two months (sixty days) from the date on which it was discovered.

 

3 – WARRANTY

All items for sale on Cicala are guaranteed to comply with the specifications shown in the published product sheets, and accompanied by original warranty and packaging if supplied by the manufacturers.

 

3.1 - WARRANTY ON WATCHES

The watches sold by Cicala, except for second-hand (used) watches, are guaranteed for a period of 24 (twenty-four) months from the date of purchase in accordance with the conditions established by the guarantee. Watches of particular value are guaranteed for 60 (sixty) months from the date of purchase in accordance with the conditions established by the guarantee.

 

The international warranty covers any defects in the material with which the watch was built as well as manufacturing defects existing at the time the watch was sold. During the warranty period and upon presentation of the valid warranty certificate (i.e. certificate bearing the date of purchase and which has been correctly filled in and stamped by Cicala) the customer will have the right to have their watch repaired free of charge by the manufacturer brand. If the repairs are inadequate to restore the normal conditions of use of the watch, the timepiece will be replaced by the manufacturer brand with a new watch with identical or similar characteristics. The obligation to replace the watch by the manufacturer brand ends 24 (twenty-four) months from the date of purchase of the watch that has been replaced.

 

The guarantee is valid only if the guarantee certificate included with the watch at the time of purchase is dated, duly completed and stamped by Cicala; therefore, once you have received your purchase, check that the guarantee contains all the details necessary for its validation.

 

The warranty does not cover: battery life; damage resulting from wear and tear and aging (such as scratches on the glass, alterations in the color and / or material of non-metallic bracelets and straps and made for example with leather, fabric, rubber, and the lack of plating); any damage to any part of the watch resulting from abnormal or unauthorized use of the watch, from lack of due attention, from negligence, from accidents (blows, dents, bumps, broken glass, etc.), from incorrect use of the watch and failure to comply with the instructions given by the manufacturer brand; any indirect damage of any nature that may arise for example from the use, malfunction, defects or lack of accuracy of the watch; watch repairs made by unauthorized persons (such as during battery changes, repairs or assistance) or watch alterations from its original condition without the supervision of the manufacturer brand.

 

Any further claim against Cicala and against the manufacturer brand is expressly excluded, such as for further damages under the aforementioned guarantee, without prejudice to any further claims that the buyer may have against the manufacturer in accordance with the law.

 

3.2 - GUARANTEE ON JEWELS

Descriptive certification relating to the gems and the title of the metal and / or precious materials used will be provided for all jewels. At the time of delivery, the Customer is required to inspect the jewel (s) in order to check for any defects or damage. If the Customer finds the presence of defects or damage, he must report it as soon as possible and Cicala will arrange for the relative return to its headquarters, at no cost to the Customer.

 

If it is ascertained that the damage to the jewel (s) occurred before delivery or that the defect is not attributable to the Customer or to the use, Cicala will provide for the relative repair or replacement or the full refund of the price paid by the Customer, including any shipping costs, provided that the damage does not derive from having worn or used the jewel (s). The warranty does not cover damage resulting from wear and tear and aging (such as scratches, discolouration and the lack of plating); any damage to any part of the jewel (s) resulting from abnormal use, lack of due attention, negligence, accidents (blows, dents, bumps, etc.), incorrect use of the jewel (s); any indirect damage of any nature that may arise from use; repairs of the jewel (s) carried out by third parties or the alterations of the jewel (s) from its original condition without the supervision of the manufacturer brand.

 

Any further claim against Cicala and against the manufacturer brand is expressly excluded, such as for further damages under the aforementioned guarantee, without prejudice to any further claims that the buyer may have against the manufacturer in accordance with the law.

 

The guarantee applies as long as the Customer reports the defect within 60 (sixty) days of its discovery. Furthermore, for some products, Cicala may issue, free of charge and at its sole discretion, an insurance policy against theft, mugging, robbery and fire lasting one year.

 

4 – PAYMENTS

Prices and shipping costs may be subject to change at any time, without prejudice to orders already confirmed by sending the mail of shipment.

 

Prices are all checked periodically. However, should the Cicala staff find a change or an error in the price upon receipt of the Customer's order, they will contact them to verify that they still intend to proceed with the purchase by applying the correct price. In the event of confirmation to this effect, the Customer is requested to remember that this does not, however, entail any obligation on the part of Cicala to provide the product(s) until the dispatch email is sent to confirm the order.

 

The prices of the products indicated on the Cicala website at the time of check-out include all taxes (including VAT) due on the purchase of the products, but excluding shipping costs, which will be automatically applied to the total amount at the time of viewing the content. of your shopping cart.

 

The payment of the product(s) must be made by credit or debit card, advance bank transfer, installment payment Soisy or Findomestic, Paypal or cash on delivery. Cicala accepts payments by Visa, ElectronVisa, MasterCard, American Express and Maestro cards. If Cicala is unable to accept the Customer's order for any reason, it reserves the right to choose whether to refuse the amount of the debit or credit card or to refund the sums paid with reference to the Customer's order.

 

No shipment of the product(s) will be made until full receipt of payment, except in cases of payment agreed by cash on delivery. Please note that a fee may be applied to the payment for online transactions if provided by the credit card issuer. This commission is not attributable to Cicala. Cicala is not able to know in any way the buyer's credit card number; the purchase procedure and payment are managed exclusively through the Banca Sella or Stripe interface. However, Cicala will not be responsible for any fraudulent or illegal use that may be made by third parties of credit cards at the time of payment.

 

Regarding payments made by card, credit and debit card holders may be subject to authorization and authentication. Cicala is not responsible for any delay or failure to deliver the product(s) ordered(s) if the card issuer or our service provider refuses or does not authorize or validate the payment for any reason.

 

By providing the information, the Customer expressly agrees to their communication to third parties; upon the subsequent discovery of further data by third parties, including, by way of example only, as the case may be, the name, address, telephone number, contact details of credit or debit cards or credit relationships; authentication of the identity and shipping address of the product(s); confirming the payment card and obtaining the necessary authorizations to pay for the product(s).

 

Other forms of payment will have to be agreed on a case-by-case basis.
The Customer's personal data will be processed by Cicala in compliance with the Privacy Policy.

 

5 - SHIPPING AND TRANSPORT

All products sold travel with free insurance coverage included for the customer at the expense of Cicala. For purchases over € 100.00, shipping in Italy is free. All products on sale on Cicala and immediately available are shipped within 1-3 working days.

 

Exceptions are products for which additional processing is required such as, for example, the service of engraving a name, or making a ring to size. The delivery time in case product customization is required will be communicated on a case-by-case basis depending on the required processing.

 

The shipment will take place by courier Bartolini, DHL or by another carrier, at the sole choice of Cicala, and always in a traceable manner by the Customer (the Customer will be provided with a tracking code to the e-mail address used for the purchase). The delivery of the ordered products will take place at the address indicated by the Customer. Cicala cannot in any case be held responsible for any delays or non-delivery due to unforeseeable circumstances or force majeure, nor for delays attributable to the carrier of the goods.

 

It is possible to choose three different shipping methods, and collection on site:

 

Standard: from 1 to 3 working days (from 8:00 to 18:00). Free in Italy for purchases over € 100.00; € 6.00 for purchases up to € 99.00.
Premium: accelerate and prioritize your order; 1 working day (from 8:00 to 18:00). Supplement € 10.00 compared to standard shipping.
Collection on site: free. The purchase will be available for collection at the headquarters of the Jewelery Cicala starting from 10:00 on the day following the purchase (for particular urgencies you can contact our Customer Service).

 

The timing expressed above is intended for all products available in stock. For products available on order, to be customized or created entirely on commission, delivery times start from the moment the product is available (the Customer will be notified by e-mail or by telephone).

 

For Southern Italy, Islands and Remote Areas, the timing may take 1-3 additional days depending on the destination areas. To guarantee the quality and efficiency of the service, we ask the Customer to carefully enter the complete shipping address, together with any notes to make delivery easier (eg preferential times).

 

For the countries of the European Union the shipping times are 1-3 working days and the costs are expressed case by case during the purchase phase depending on the country of destination. For countries outside the EU, shipping times are usually 2-5 working days, excluding any time necessary for customs clearance of the goods. The cost of shipping is clearly expressed during the purchase phase depending on the country of destination; any customs duties are always charged to the customer.

6 - RIGHT OF WITHDRAWAL

Subject to the detailed terms and conditions, the Customer, pursuant to Article 52 of the Consumer Code, has the right, in addition to the other rights due to him, to withdraw from this Agreement without just cause and to receive a refund of the price paid included any shipping costs (any shipping costs incurred by Cicala will not be reimbursed).

 

6.1 – PERIOD TO EXERCISE THE RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the Contract at any time before the order is delivered and up to 30 days after that date from the day of purchase of his order (cooling-off period).

To exercise the right of withdrawal, the Customer is required to give unequivocal communication, preferably in writing:

    • to Cicala Snc, Via Martiri della Libertà, 23r - 16156 Genoa (Italy);
    • by e-mail to the address reclami@cicala.it (specifying your full name, address, telephone number and order number);
    • by filling in the appropriate withdrawal form available online on the website and sending it to the addresses listed above.

 

6.2 – PRODUCTS THAT CANNOT BE RETURNED

Products cannot be returned to Cicala in the cases referred to in Article 59 of the Consumer Code, for example for the purchase of specially customized, engraved or individualized products; for the supply of sealed items that cannot be returned for health or hygiene reasons whose seals have been removed after delivery, etc.

 

6.3 – GIFTS PURCHASED ON CICALA.IT

The recipients of gifts purchased on Cicala.it are entitled to the replacement of the products but not to a refund unless requested by the one (the Customer) who placed the order. To request a product change or a refund to the buyer (Customer), it is necessary to follow the instructions provided in the package sent by Cicala.

 

 

7 - RETURN

If the Customer decides to withdraw from the Contract, he is required to return the product(s) following the instructions that he will find inside the package.

 

After having communicated the desire to exercise the right of withdrawal, by e-mail at reclami@cicala.it or by telephone at the Free Toll-Free Number 800 865 648 (from landlines in Italy) or at +39 010 6981030 (from mobile phones or from abroad), the products must be returned to Cicala within 30 (thirty) days from the date of purchase or within 14 (fourteen) days from the notification of withdrawal, in the same conditions in which they were delivered.

 

The Customer is required to observe the necessary diligence in the care of the product (s) in his possession. The product must be returned in perfect condition, in its original packaging and complete with all accessories that may be supplied at the time of purchase (warranty, case, instructions, etc.), together with the purchase document. All products customized, modified or created on commission are exceptions; for the latter, any possibility of refund and return lapses.

 

Before proceeding with the shipment, Cicala recommends agreeing the return procedures with the Customer Service (available from Tuesday to Saturday from 9:00 to 12:30 and from 15:30 to 19:30 at the addresses indicated above). The Customer is also invited to forward in advance photographs of the product he wishes to return in order to be able to prove its good condition.

 

The Customer can proceed with the shipment of the return using any courier or post office, thus choosing the means he prefers, bearing the risk of loss and the related costs. The cost of shipping for the return is always borne by the buyer.

8 – REFUND

If the product(s) is returned(s) according to the terms indicated, Cicala will refund the full price of the product(s), except for any deductions due due to the use and damage of the product as well as the standard shipping costs paid.

 

Cicala will refund the amount using the same payment method used by the Customer, or by bank transfer, within 14 days of receipt of the goods for which the right of withdrawal has been exercised.

 

9 – COMPLAINTS

Any complaints must be sent by registered letter with return receipt. to Cicala and advance, if possible, by e-mail to the address reclami@cicala.it with the subject: 'Complaint' followed by the purchase order number.

 

10 – DISPUTES

For any dispute between the parties regarding this contract, the Court in whose district the consumer has his domicile or residence will be competent, according to current legislation, provided that this place is located within the Italian Republic.

 

The Customer has the right to request the application of an out-of-court resolution mechanism for disputes arising from the Contract with the competent bodies set up by the Chambers of Commerce pursuant to the Law of 29 December 1993, no. 580, as well as the mediation procedure pursuant to Legislative Decree no. 28/2010 and subsequent amendments, in accordance with the provisions applicable by the body selected by you, without prejudice to the possibility of using the voluntary negotiation procedures referred to in Article 2, paragraph II of the aforementioned Legislative Decree, as well as the complaint procedures provided by the service charters.

 

Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he or she may submit a complaint via the ODR platform of the European Union which can be reached by clicking on the following link http://ec.europa.eu/consumers/odr/. Any invalidity or ineffectiveness ascertained in the courts of one or more clauses of these Conditions of Sale does not affect the validity and effectiveness of the remaining provisions.

 

No delay or failure to exercise the powers, rights or remedies granted under these Conditions of Sale will be valid as a waiver of the same, nor the partial exercise of these powers, rights or remedies will prevent the further exercise of the same in the future.

 

Any communications to Cicala must be made in writing to the address indicated at the beginning of these Conditions of Sale. Any communications to the Customer can be made both to the e-mail address and to the postal address provided at the time of sending the Order.

 

10.1 - CONCILIATION PROCEDURE

According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can use the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after submitting a complaint to the company, has not received a response within 45 days or has received a response that is not deemed satisfactory by him.

These Conditions of Sale and any other document expressly referred to in them constitute the entire agreement between the parties with reference to the subject of the Contract. The Contract and any further communication between the parties will be formulated in Italian.

 

The form, existence, construction, execution, validity and any other aspect of these Conditions of Sale or any of the clauses contained therein are governed by Italian law.
