Cicala recommends that you carefully read these Conditions of Service before ordering the service on the website. These conditions, together with the Privacy Policy , govern mutual relationships in relation to the use of the website and the purchase by the Customer of a Cicala service via the Cicala website or by telephone communication. For any questions regarding these conditions, or if the Customer does not intend to accept their application, it is possible to contact Customer Service at the email address support@cicala.it or on the telephone number 0039 010 6981030 before proceeding further.

 

 

ART. 1 – OBJECT

A - WORK PERFORMANCE - STANDARD ENGRAVING

The Standard Engraving Service is carried out by Cicala jewelers upon indication of the Customer, therefore it can be qualified as a professional work contract and includes the manual or mechanical engraving of a jewel or watch through the use of professional equipment (e.g. Laser engraving systems, pantograph). The Service is purchased online by placing it in the cart, and the confirmation is sent via the 'Confirm and pay' button. We remind you that once placed, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours of the order to the Cicala email address ( support@cicala.it ). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

 

B - WORK PERFORMANCE - RING MEASUREMENT

The ring tailoring service is carried out by Cicala jewelers upon indication of the Customer, therefore it can be qualified as a contract for the provision of professional work and includes the execution of a modification, using professional instruments, of the structure of a ring so that it respects the size requirement requested by the Customer. The Service is purchased online by placing it in the cart, and the confirmation is sent via the 'Confirm and pay' button. We remind you that once placed, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours of the order to the Cicala email address ( support@cicala.it ). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

 

C - WORK SERVICE - CUSTOMIZATION OF NECKLACES

The Necklace Customization Service is carried out by Cicala jewelers upon indication of the Customer, therefore it can be qualified as a professional work contract and includes the addition of a nickel free hypoallergenic 18kt white, yellow or rose gold plate to a necklace . The Service is purchased online by placing it in the cart, and the confirmation is sent via the 'Confirm and pay' button. We remind you that once placed, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours of the order to the Cicala email address ( support@cicala.it ). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

 

D - WORK PERFORMANCE - DESIGN AND PROTOTYPING

The Design and Prototyping Service is carried out by Cicala jewelers upon indication of the Customer, therefore it can be qualified as a contract for the provision of professional work and includes the creation of graphic drafts and/or prototypes by a Cicala jeweler following the requests provided by the Customer. The Service is purchased online by placing it in the cart and using the 'Confirm Order' button. We remind you that once placed, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours of the order to the Cicala email address ( support@cicala.it ). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

 

E - INTELLECTUAL WORK - PROFESSIONAL CONSULTANCY

The Professional Consultancy Service is performed by Cicala jewelers and consists of customer support activities: 1) in the choice of jewels; 2) in direct professional assistance for the creation of new jewels; 3) in jewelery and goldsmith work on existing models and products. Orders are placed online with the choice of product via the 'Confirm and pay' button. We remind you that once placed, orders cannot be modified or canceled by the buyer. Any error must be reported within 24 hours of the order to the Cicala email address ( support@cicala.it ). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

 

ART. 2 – STORAGE OF THE CONTRACT

The order form will be archived in the database of the Cicala headquarters in Genoa, Italy for the time necessary for its execution and, in any case, within the terms established by law. The user will be able to access the order form and/or the data relating to it through their personal account on the Cicala website. For more information, please see our Privacy Policy .

 

ART. 3 – PLACE OF EXECUTION OF THE WORK

All work and intellectual work, the execution of estimates for the repair of jewelery and watches (points A, B, C, D, E) are carried out at the headquarters of the Cicala jewelery shop or at the goldsmith laboratories of the Gioielleria Cicala, internal and external, as well as by collaborators and professionals who, in any capacity, carry out professional and intellectual work.

 

ART. 4 – PAYMENTS AND PRICES

Payment for the service takes place at the time of purchase on the site. Prices may be subject to change at any time, without prejudice to orders already validated by sending the order confirmation email. Prices are all checked periodically. However, should the Cicala staff find a variation or error in the price when receiving the Customer's order, they will contact him to verify that he still intends to proceed with the purchase by applying the correct price. In case of confirmation in this sense, the Customer is asked to remember that this does not imply any obligation on the part of Cicala to provide the service(s). The prices indicated on the Cicala website at check-out include all taxes (including VAT) due on the purchase of services. Payment for the service(s) must be made by credit or debit card, advance bank transfer, Klarna , Paypal or PagoLight . Cicala accepts payments via Visa, MasterCard, American Express and Maestro cards. If Cicala is unable to accept the Customer's order for any reason, it reserves the right to choose whether to refuse the amount of the debit or credit card or to refund the sums paid in relation to the Customer's order.

 

ART. 5 – START OF WORK, DURATION AND EXEMPTION FROM LIABILITY

The start of the works is agreed between Gioielleria Cicala and the Customer, following the signing of the online contract. Following the order, Customer Service will contact the buyer in order to collect all the useful and necessary elements to be able to proceed with the creation of the requested work and begin the execution of the work. In case of failure of the Customer to cooperate, the articles will apply. 1206 ss cc and no responsibility can be attributed to Gioielleria Cicala for the delay or failure to provide. In the cases referred to in the previous period, the price paid for the provision of the Service will be retained by Gioielleria Cicala as compensation for the time resources and/or materials used by the professional to deal with the request not completed. The duration of the works is agreed with the Customer, after having collected all the information useful for its determination, having regard to the complexity of the work to be carried out.

5.1 Obligations of the Consultant and the Client (point E)

By taking on the assignment for the jewelery consultancy service, the Consultant undertakes to maintain his work using the diligence required by the nature of the activity carried out. The Client has the obligation to make known and promptly send to the Consultant all the documentation and information necessary to carry out the assignment.

5.2 Implementation times of the design and prototyping service (point D)

Following the order, Customer Service will contact the buyer in order to collect all the useful and necessary elements to be able to proceed with the creation of the requested work and begin the execution of the work. In case of failure of the Customer to cooperate, the articles will apply. 1206 ss cc and no responsibility can be attributed to Gioielleria Cicala for the delay or failure to provide. In the cases referred to in the previous period, the price paid for the provision of the Service will be retained by Gioielleria Cicala as compensation for the time and material resources used by the professional to deal with the request which was not completed.

5.4.1 Duration of the works

The duration of the works is agreed with the Customer, after having collected all the information useful for its determination, having regard to the complexity of the work to be carried out

 

ART. 6 – METHOD OF EXECUTION OF THE WORK

The Contractor undertakes to carry out and complete the work with diligence, professionalism and in a workmanlike manner. The Customer can always request updates on the execution and its progress by making a request directly to: support@cicala.it .

6.1 How to carry out the standard engraving service (point A), the ring sizing service (point B), the necklace customization service (point C)

Before starting the execution of the work, the Work Provider sends the customer a detailed email and/or a graphic draft of the ordered work. Only after having obtained the customer's consent to continue the work, Gioielleria Cicala will begin the commissioned works.

6.2 Method of carrying out the design and prototyping service (point D)

The Provider, with this service, undertakes to create the graphic prototype of the product requested by the customer. The service does not include the creation of the jewel, or the actual goldsmith work, which must be regulated and purchased with a separate contract. The Customer can always request updates by writing directly to: support@cicala.it .

 

ART. 7 – CHANGES IN PROGRESS

The Provider undertakes to promptly and preventively communicate to the Customer any further work that during the execution may become necessary for the correct execution of the work compared to those estimated, as described in points A, B, C, D, E ( Object of the contract”) of these General Conditions of Service (Provision of Work).

The communication, including the cost relating to the new works and any new delivery date, must be expressly accepted in writing by the Customer. If the Customer accepts the new conditions, they will be valid towards Gioielleria Cicala in derogation of the original agreement on the price and subject of the work.

 

ART. 8 – ACCEPTANCE OF THE WORK AND DIFFERENCES

Once the work has been completed, following collection from the shop or delivery to his hands, the Customer must proceed to verify the same in order to carry out acceptance or detect any defects or discrepancies with respect to what he seen and accepted at the start of the works. The express or tacit acceptance of the work by the Customer frees the provider from liability for discrepancies or defects if these were known to the Customer or if they could be easily recognizable by the Customer, provided they were not maliciously concealed. The Customer must, under penalty of forfeiture, report the discrepancies and defects to Gioielleria Cicala within eight days of discovery by registered letter or by electronic communication sent to the address: support@cicala.it.

These conditions (Acceptance of the work and discrepancies) are not applicable to services D (design and prototyping) and E (jewellery consultancy) of this contract.

 

ART. 9 – EXCLUSION OF THE CUSTOMER'S RIGHT OF WITHDRAWAL FROM THE CONTRACT

Pursuant to art. 59 of the Consumer Code, the provision of work for the creation of products on request does not make the regulation on the right of withdrawal applicable .

 

ART. 10 – SUPERVISING IMPOSSIBILITY OF THE EXECUTION OF THE WORK

If the execution of the work becomes impossible for reasons not attributable to any of the parties, the Work Provider has the right to compensation for the work performed in relation to the usefulness of the part of the work completed. This amount is assessed from time to time at the discretion of the parties.

 

ART. 11 – COMPLAINTS

Any complaints must be forwarded by registered letter with return receipt to Cicala and anticipated, if possible, by e-mail to complaint@cicala.it with the subject: "Complaint" followed by the purchase order number.

 

ART. 12 – DISPUTES

For any dispute between the parties regarding this contract, the court in whose district the consumer has his domicile or residence will be competent, in accordance with current legislation, provided that this place is located within the Italian Republic.

12.1 Joint conciliation procedure

Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute he can submit a complaint via the European Union ODR platform which can be reached by clicking on the following link ec.europa.eu/consumers/odr/ . The ODR platform constitutes an access point for users who wish to resolve disputes arising from sales or online service contracts out of court. For further information contact: support@cicala.it .

According to article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can make use of the Joint Conciliation procedure. The Procedure can be started if the consumer, after having submitted a complaint to the company, within 45 days, has not received a response or has received a response that is not considered satisfactory by him. The customer who decides to make use of the Joint Conciliation procedure is obliged to send the request to the address:

These conditions (10.1 Joint conciliation procedure) are not applicable to service E (jewellery consultancy).

 

ART. 13 – FINAL CLAUSES

In the future it may no longer be possible to view these Terms of Service or your online order; we therefore recommend that you print a copy for later consultation. These General Conditions of Service (Performance of Work) and any other document expressly referred to therein constitute the entire agreement between the parties with reference to the object of the Contract. The Contract and any further communication between the parties will be formulated in Italian. The form, existence, construction, execution, validity and any other aspect of these Terms of Service or any of the clauses contained therein are governed by Italian law.

 

ART. 14 – CODE OF CONDUCT

Cicala.it adheres to the guidelines of the Ecommerce Europe Code of Conduct , has obtained the trustability logo and declares its commitment to constant compliance with sector regulations.
