INTRODUCTION

Cicala recommends that You read these Terms of Sale carefully before ordering the products on the website. These Conditions, together with the Privacy Policy, govern the mutual relations in relation to the use of the website and the purchase by the Customer of a Cicala product through the Cicala website or by telephone. For any questions regarding these conditions, or if the Customer does not intend to accept the application, it is possible to contact Customer Service at the email address support@cicala.it or by phone +39 010 6981030 before proceeding further.

The following information is provided pursuant to Article 49 of the Consumer Code (Legislative Decree 6 September 2005, n. 206).

By clicking on the "Confirm Order" button on the website during the final purchase phase, the Customer declares to accept these Conditions of Sale. Please note that in the event of non-acceptance of these Conditions of Sale, it will not be possible to purchase any product on the Cicala website.

1 - TERMS OF SALE

Orders are made online with the choice of the product via the 'Order Confirmation' button. We remind You that after submission, orders cannot be modified or canceled by the buyer. A possible error must be reported within 24 hours from the order to the email address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

The product will be shipped accompanied by a purchase receipt, a possible receipt (if necessary, for the validation of the guarantees) and any invoice addressed to the purchaser (if the Customer has provided his Fiscal Code/Document ID and has explicitly requested it during the phase of purchase).

Since the items offered by Cicala are also sold in physical stores, the selected jewel may not be immediately available. In this case it will be Cicala's responsibility to inform the Customer before the purchase is accepted, the exact delivery time.

1.1 - Conclusion of the contract

The order form will be filed in the database of the Cicala headquarters in Genoa, Italy for the time necessary for the execution of the same and, in any case, within the terms established by law. The user can access the order form and/or the related data through his personal account at the Cicala website. For more information see our Privacy Policy.

2 - PRODUCTS AND PRICES

Only original articles are sold on Cicala. All the products offered are accompanied by boxes and official guarantees of the respective companies and manufacturers. The prices shown in the product data sheets on the site are inclusive of VAT and are the normal list prices recommended by the manufacturers and with which Cicala exhibits the products in its physical stores. The final price including shipping costs, insurance and any customs charges will be highlighted and clearly visible before the final order confirmation. Any customs charges for shipments outside the European Union are excluded.

2.1 - Trademark concessions

Cicala does not necessarily hold the status of official dealer of all the brands offered for sale, and therefore does not entertain direct commercial relationships with all the companies that own the brands. Cicala, in any case, always guarantees the absolute originality, the legitimate origin and the perfect integrity of the marketed products, which are always accompanied by their official kit (box and warranty).

2.2 - Vintage jewelry and watches

Cicala enriches the proposals intended for its customers with period jewels and watches, or at least not new, or collectibles, and that present characteristics of exceptional quality combined with a price of sure convenience and occasion. For these products the general characteristics are always well specified: the material, the conditions in which the jewel is sold and the warranty issued. For each product, strictly selected, checked and possibly restored, Cicala issues a certificate of legitimate origin with a warranty of originality and operation for 24 months. For all items of this type the warranty is accompanied by photographs that show and highlight even the smallest details.

2.3 - Promotions and discounts

Cicala rewards its loyal customers with truly advantageous favorable treatments. A first significant concession can be obtained free of charge and without purchase obligation by registering on Cicala and subscribing to the newsletters. Other discounts and promotions will be available, exclusively for members, during various times of the year. All products offered for promotion are not subject to further discounts and/or promotions.

2.4 - Photographs of the products

Cicala independently produces the photographs of its jewels offered for sale on the website: all the images of the jewels represent exactly the final jewel that the customer can buy. The watches and jewels produced by the brand are sold using the official images provided by the respective manufacturer brands. Some objects may appear slightly larger or smaller than the actual size of the object in order to adapt the object to the screen or due to particular photographic techniques. Other elements may be depicted in a larger size than the real one in order to clearly show the details, or smaller than the actual dimensions in order to show the entire article.

2.5 - Damaged or defective products

Upon delivery of the package, the Customer is required to inspect the product(s) in order to check for defects or damage. If the Customer detects the presence of defects or damages, he will have to report it as soon as possible and Cicala will organize for the relative return to its headquarters, without any cost for the Customer.

If it is found that the damage to the product(s) occurred before delivery, or that the defect is not attributable to fault or use by the Customer, Cicala will arrange for its repair or replacement or full refund of the price paid by the Customer, including any shipping costs, provided that the damage does not result from having worn or used the product(s).

If the Customer prefers the repair or replacement of the product(s), he is asked to contact Cicala who will replace the item without any additional expense where this is reasonably possible. In addition, the expenses incurred for returning the item will be reimbursed to the Customer. In the event of a lack of conformity of the products pursuant to Article 129 of the Consumer Code, the legal guarantees set forth in Articles 129 et seq. Apply. of the Consumer Code. The Customer has the right to restore, without charge, the conformity of the goods by repair or replacement. In case of impossibility to carry out the above remedies, the Customer has the right to an adequate reduction of the price of the products, or to the termination of the contract. These rights are deemed to have been waived if the lack of conformity is not notified within two months (sixty days) of the date on which it was discovered.

3 - WARRANTY

All items for sale on Cicala are guaranteed to comply with the specifications shown on the published product data sheets and come with original warranty and packaging provided by the manufacturers.

3.1 - Warranty on watches

The watches sold by Cicala, except for second-hand watches (used), are guaranteed for a period of 24 (twenty-four) months from the date of purchase in accordance with the conditions set by the warranty.

The international warranty covers any defects in the material with which the watch was built as well as manufacturing defects existing at the time the watch was sold. During the warranty period and upon presentation of the valid guarantee certificate (ie a certificate which bears the date of purchase and which has been correctly filled in and stamped by Cicala) the Customer will have the right to have his watch repaired free of charge by the manufacturer brand. If the repairs are inadequate to restore the normal conditions of use of the watch, the timepiece will be replaced by the manufacturer brand with a new watch having identical or similar characteristics. The obligation to replace the watch by the brand manufacturer ceases 24 (twenty-four) months from the date of purchase of the watch which has been replaced.

The warranty is valid only if the warranty certificate enclosed with the watch at the time of purchase is dated, duly completed and stamped by Cicala; then check, once you have received Your purchase, that the warranty includes all the details necessary for its validation.

The warranty does not cover: battery life; damage resulting from wear and aging (such as glass scratches, alterations in the color and/or material of non-metallic bracelets and straps and made for example with leather, fabric, rubber, and the loss of plating); any damage to any part of the watch that results from abnormal or unauthorized use of the watch, from lack of due attention, from negligence, from accidents (blows, dents, bumps, broken glass, etc.), from the incorrect use of the watch and failure to follow the instructions given by the manufacturer brand; any indirect damage of any kind that may arise for example from use, malfunction, defects or lack of precision of the watch; repairs to the watch made by unauthorized persons (such as during battery changes, repairs or assistance) or alterations of the watch from its original condition without the supervision of the manufacturer brand.

Any further claim against Cicala and against the manufacturer brand is expressly excluded, for example for further damage under the aforementioned warranty, except for any further claim that the buyer may have against the manufacturer pursuant to the law.

3.2 - Warranty on jewelry

For all the jewels, descriptive certification will be provided for the gems and the quality of the metal and/or precious materials used. Upon delivery, the Customer is required to inspect the jewel(s) in order to check for defects or damage. If the Customer detects the presence of defects or damage, he must report it as soon as possible and Cicala will organize for the relative return at its own site, without any cost from the Customer.

If it is found that the damage to the jewel(s) occurred before delivery or that the defect is not attributable to the Customer or use, Cicala will arrange for its repair or replacement or full refund of the price paid by the Customer, including any shipping costs, provided that the damage does not result from having worn or used the jewel (s). The warranty does not cover damage resulting from wear and tear (such as scratches, color changes and the loss of platings); any damage to any part of the jewel(s) resulting from abnormal use, lack of due attention, negligence, accidents (blows, dents, knocks, etc.), from the incorrect use of the jewel(s); any indirect damage of any nature that may arise from use; repairs of the jewel(s) performed by third parties or alterations of the jewel(s) from its original condition without the supervision of the manufacturer brand.

Any further claim against Cicala and against the manufacturer brand is expressly excluded, for example for further damage under the aforementioned warranty, except for any further claim that the buyer may have against the manufacturer pursuant to the law.

The warranty applies provided that the complaint of the defect by the Customer takes place within 60 (sixty) days from its discovery. In addition, for some products, Cicala may issue a one-year insurance policy against theft and robbery at its sole discretion.

4 - PAYMENTS

Prices and shipping costs may be subject to change at any time, subject to orders already confirmed with the dispatch of the e-mail sent.

The prices are all checked periodically. However, if the Cicala staff find a variation or an error in the price at the time when receiving the Customer's order, they will contact him to verify that he intends to proceed with the purchase by applying the correct price. In case of confirmation in this sense, the Customer is requested to remember that this does not however imply any obligation on the part of Cicala to supply the products(s) until the dispatch e-mail is sent to confirm the order.

The prices of the products indicated on the Cicala website at the time of check-out include all the taxes (including VAT) due on the purchase of the products, but excluding shipping costs, which will be automatically applied to the total amount at the time the content is displayed in the cart.

The payment of the product(s) must be made by credit or debit card, advance bank transfer or cash on delivery. Cicala accepts payments by Visa, MasterCard, American Express and Maestro cards. If Cicala is not able to accept the Customer's order for any reason, he reserves the right to choose whether to reject the amount of the debit or credit card or to refund the sums paid with reference to the Customer's order.

No shipment of the product(s) will be made until full payment has been received, except in the case of payment agreed by Cash on delivery. Please note that an online transaction fee may apply to the payment if provided by the credit card issuer. This fee is not attributable to Cicala. Cicala is not able to know in any way the buyer's credit card number; the purchase and payment procedure are managed exclusively through the Banca Sella interface. However, Cicala will not be responsible for any fraudulent or illegal use that may be made by a third party of credit cards at the time of payment.

With regards to card payments, credit and debit card holders may be subject to authorization and authentication. Cicala is not responsible for any delay or failure to deliver the ordered product(s) if the card issuer or our service provider refuses or does not authorize or validate the payment for any reason.

By providing the information, the Client expressly consents to their communication to third parties; to the subsequent discovery of further data by third parties, including, by way of example only, the name, address, telephone number, credit or debit card details or credit reports, as the case may be; to the authentication of the identity and shipping address of the product(s); upon confirmation of the payment card and obtaining the authorizations necessary to make payment of the product(s).

Other forms of payment must be agreed on a case by case basis.
The Customer's personal data will be processed by Cicala in compliance with the Privacy Policy.

5 - SHIPPING AND TRANSPORT

All products sold travel with free insurance coverage included for the Customer paid by Cicala. For purchases over € 100,00 shipping in Italy is free. All products available for sale on Cicala and immediately available are shipped within 2-3 working days.

Exceptions are products for which an additional processing is required such as, for example, the service of engraving a name, or ring size adjusting. The delivery time if the customization of the products is requested will be communicated on a case by case basis according to the required processing.

The shipment will be made by DHL courier or through another carrier, at Cicala's unquestionable choice, and always in a manner traceable by the Customer (the Customer will be provided with a tracking code at the e-mail address used for the purchase). The delivery of the ordered products will take place at the address indicated by the Customer. Cicala cannot in any case be held responsible for any delays or non-delivery due to unforeseeable circumstances or force majeure, nor for delays attributable to the carrier of the goods.

You can choose between two different shipping methods:

  • Standard: 2 to 3 working days (from 8:00 to 18:00). Free in Italy for purchases over €100; €10 for purchases under €99.
  • Premium: accelerate and prioritize the order; from 1 to 2 working days (from 8:00 to 18:00). €10 supplement added to Standard shipping cost.

The above expressed timing is meant for all the products available in stock. For products available on order, to be customized or to be created entirely on commission, delivery times start from the moment the product is available (the Customer will be notified by e-mail and/or by telephone).

For Southern Italy, Islands and Remote Zones the timing may require an additional day depending on the destination areas. To guarantee the quality and efficiency of the service, we ask the Customer to carefully enter the complete shipping address, together with any notes to make delivery easier (example: preference times).

For European Union countries shipping times are 1-3 working days and the costs are expressed on a case-by-case basis during the purchase phase depending on the destination country. For non-EU countries, shipping times are usually 2-5 working days, excluding any time needed for the customs clearance of the goods. The cost of shipping is expressed in clear during the purchase phase depending on the destination country; any customs charges are always charged to the Customer.

6 - RIGHT OF WITHDRAWAL

Subject to the detailed terms and conditions, the Customer, in accordance with Article 52 of the Consumer Code is entitled, in addition to the other rights due to him, to withdraw from this Agreement without just cause and to receive a refund of the price paid including any shipping costs (any shipping costs incurred by Cicala will not be reimbursed).

6.1 - Period for exercising the right of withdrawal

The Customer has the right to withdraw from the Contract at any time before the order is delivered and up to 30 days after that date from the day of purchase of his order. To exercise the right of withdrawal, the Customer is obliged to give unequivocal communication, preferably in writing:

  • to Cicala Snc, Via Martiri della Libertà, 23r – 16156 Genoa (Italy);
  • via e-mail to support@cicala.it (specifying full name, address, telephone number and order number);
  • filling in the appropriate withdrawal form available online on the website and sending it to the above addresses.

6.2 - Products that cannot be returned

They cannot be returned to Cicala products in the cases referred to in Article 59 of the Consumer Code, for example for the purchase of specially customized, engraved or individualized products; for the supply of sealed items that cannot be returned for sanitary or hygienic reasons, after which the seals, etc., have been removed.

6.3 - Gifts purchased on Cicala

The recipients of gifts purchased on Cicala have the right to replace the products but not to reimbursement unless requested by the person (the Customer) who placed the order. To request a change of product or a refund to the buyer (Customer) it is necessary to follow the instructions provided in the package sent by Cicala.

7 - Return

If the Customer decides to withdraw from the Contract, he is required to return the product(s) following the instructions he will find inside the package.

After having communicated the intention to exercise the right of withdrawal, by e-mail at the address support@cicala.it or by telephone at the number +39 010 6981030, the product(s) must be returned to Cicala within 30 (thirty) days from the date of purchase or within 14 (fourteen) days from the notification of withdrawal, in the same conditions in which they were delivered.

The Customer is required to observe the necessary diligence in the care of the product(s) in its possession. The product must be returned in perfect condition, in its original packaging and complete with all the accessories that may be supplied at the time of purchase (warranty, case, instructions, etc.), together with the purchase document. Exceptions are all customized products, modified or commissioned; for these last repayments and returns are void.

Before proceeding with the shipment, Cicala recommends agreeing the return procedures with the Customer Service (available from Tuesday to Saturday from 9:00 to 12:30 and from 15:30 to 19:30 at the addresses listed above). The Customer is also invited to forward photographs of the product he wishes to return in advance in order to prove its good condition.

The customer can proceed with the shipment of the return using any courier or post office, thus choosing the means he prefers, bearing the risk of loss and the related costs. The cost of the return shipment is always borne by the buyer.

8 - Refund

If the product(s) is (are) returned according to the indicated terms, Cicala will reimburse the full price of the product(s), except for any deductions due to the use and damage of the product(s) as well as the standard shipping costs paid. Cicala will refund the amount using the same payment method used by the Customer, or by bank transfer, within 14 days from the receipt of the goods for which the right of withdrawal has been exercised.

9 - COMPLAINTS

Any complaints must be sent by registered letter with return receipt. to Cicala and anticipated, if possible, by e-mail to the address cicala@cicala.it with the subject: 'Claim' followed by the purchase order number.

10 - DISPUTES

Any dispute between the parties regarding this contract will be settled by the court in whose district the consumer, the law in force, is domiciled or resident, provided that the place is located within the Italian Republic.

The Customer has the right to request the application of an out-of-court resolution mechanism for disputes arising from the Contract with the competent bodies set up by the Chambers of Commerce pursuant to the Law of December 29, 1993, no. 580, as well as the mediation procedure pursuant to Legislative Decree no. 28/2010 and subsequent amendments, in accordance with the provisions applicable by the body selected by you, without prejudice to the possibility of using the voluntary negotiation procedures referred to in Article 2, paragraph II of the aforementioned Legislative Decree, as well as the complaint procedures provided by the service cards.

According to the art. 14 of Regulation 524/2013 informs the user that in the event of a dispute, they can submit a complaint via the European Union ODR platform accessible by clicking on the following link http://ec.europa.eu/consumers/odr/. The ODR platform is an access point for users who wish to settle disputes arising from sales contracts or online services in the extra-judicial area. For more information contact: support@cicala.it.

Any invalidity or ineffectiveness ascertained in the jurisdiction of one or more clauses of these Conditions of Sale does not affect the validity and effectiveness of the remaining provisions.No delay or failure to exercise faculties, rights or remedies attributed to these Sales Conditions may be deemed a waiver of the same, nor may partial exercise of these powers, rights or remedies prevent the further exercise of them in the future.

Any communications to Cicala must be made in writing to the address indicated at the beginning of these Conditions of Sale. Any communications to the Customer may be made either to the e-mail address or to the postal address provided at the time the Order was sent.

10.1 - Conciliation procedure

According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can use the Joint Conciliation procedure. The Procedure can be started if the consumer, after having lodged a complaint with the company, within 45 days, has not received a reply or has received a reply not deemed as satisfactory by him.

The customer who decides to take advantage of the Joint Conciliation procedure is obliged to transmit the application to the address:

11 - OTHER USEFUL INFORMATION

In the future it may no longer be possible to view these Conditions of Sale or your order placed online; we therefore recommend that you print a copy for later reference. You can download a pdf version of these Conditions of Sale at this link.

These Conditions of Sale and any other document expressly referred to in them constitute the entire agreement between the parties with reference to the subject of the Contract. The Contract and any further communication between the parties will be formulated in Italian.

The form, existence, construction, execution, validity and any other aspect of these Conditions of Sale or any of the clauses contained therein are governed by Italian law.

Art. 1 – OBJECT

A - Provision of work - Premium jewelry engraving

The premium engraving service is performed by Cicala jewelers on the Client's instructions; therefore, it can be qualified as a professional work contract and includes the manual or mechanical engraving of a jewel or watch through the use of professional equipment (eg Laser engraving systems, pantograph). The Service is purchased online by entering it in the shopping cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. A possible error must be reported within 24 hours from the order to the email address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

B - Provision of work – Ring size adjustment

The ring size adjustment service is performed by Cicala jewelers on the Client's request, therefore it can be qualified as a professional work performance contract and includes the execution of a modification, through professional instruments, of the structure of a ring so that it respects the size requirement requested by the Customer. The Service is purchased online by entering it in the shopping cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. A possible error must be reported within 24 hours from the order to the email address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

C - Provision of work - Ring size adjustment and engraving

The service of ring size adjustment and engraving is performed by Cicala jewelers on the Client's indication, therefore it can be qualified as a professional service contract and includes the execution of a modification, through professional instruments, of the structure of a ring so that it respects the size requirement requested by the Customer and the execution of a manual or mechanical engraving through the use of professional equipment (eg laser engraving systems, pantograph. The Service is purchased online through insertion in the cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after the forwarding, the orders cannot be modified or canceled by the buyer. A possible error must be reported within 24 hours from the order to the e-mail address di Cicala (support@cicala.it) The contract is finalized upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

D - Provision of work - Personalization of necklaces

The personalization of necklaces Service is performed by Cicala jewelers on the Client's indication; therefore, it can be qualified as a professional work performance contract and includes the addition of an 18kt allergy-free nickel free white, yellow or pink gold nameplate to a necklace. The Service is purchased online by entering it in the shopping cart, and the confirmation sent by means of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. A possible error must be reported within 24 hours from the order to the email address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

E - Provision of intellectual work - Jewelry consultancy

The Jewelry Consultancy Service is performed by Cicala jewelers and consists of customer support activities: 1) in the choice of precious items; 2) in professional assistance directed to the creation of new jewels; 3) in the intervention of jewelry and goldsmithery on existing models and products. Orders are made online with the choice of the product via the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. A possible error must be reported within 24 hours from the order to the email address of Cicala (support@cicala.it). The contract is concluded upon confirmation of the order by Cicala, order confirmation which will be sent to the email address communicated by the Customer.

F - General Terms of Service – Jewelry repair quotation

With the purchase of the Service of Jewelry Repair Quotation, the Customer exclusively acquires the right to receive a personalized quotation regarding the Repair Service, which will constitute, with separate purchase of the service by the Customer, the actual contract between the set off.
The budget for the repair of a jewel is professionally executed by a jeweler Cicala at the Genoa headquarters. The service allows you to know in detail how much it would cost to repair your jewel to bring it back to perfect conditions and does not imply additional obligations for the parties. Orders are made online with the choice of the service, the insertion of the same in the cart and the confirmation sent via the button 'Confirm Order'. G - General Terms of Service – Watches repair quotation

With the purchase of the Watches Repair Quotation Service, the Customer exclusively acquires the right to receive a personalized quotation for the Repair Service, which will constitute, with separate purchase of the service by the Customer, the actual contract between the parties. The estimate for the repair of a watch is professionally performed by a Cicala jeweler/watchmaker at the Genoa headquarters or at an authorized watchmaking laboratory in the case of particularly valuable watches and for which original components and spare parts were required. The service allows you to know in detail how much it would cost to repair your watch to bring it back to perfect conditions and does not imply additional obligations for the parties. Orders are made online with the choice of the service, the insertion of the same in the cart and the confirmation sent via the button 'Confirm Order'. H - Provision of work - Design and prototyping

The Design and Prototyping Service is performed by Cicala jewelers on the Client's request; therefore, it can be qualified as a professional work performance contract and includes the creation of graphic drafts and / or prototypes by a Cicala jeweler following the requests provided by the Customer. The Service is purchased online through the inclusion in the cart, and the use of the 'Order Confirmation' button. We remind you that after submission, orders cannot be modified or canceled by the buyer. Art. 2 - ARCHIVING THE CONTRACT

The order form will be filed in the database of the Cicala headquarters in Genoa, Italy for the time necessary for the execution of the same and, in any case, within the terms established by law. Art. 3 - PLACE OF EXECUTION OF THE WORK

All services and intellectual works, the execution of estimates for the repair of jewelry and watches (points A, B, C, D, E, F, G, H) are carried out at the Cicala jewelry headquarters or at the goldsmith laboratories of Jewelry Cicala, internal and external, as well as from collaborators and professionals who, for whatever reason, perform professional and intellectual work..

Art. 4 - PAYMENTS AND PRICES

The payment of the service takes place at the time of purchase on the site. Prices may be subject to change at any time, subject to orders already validated by sending the order confirmation email. The prices are all checked periodically. However, should the Cicala staff find a variation or an error in the price at the time of receiving the Customer's order, they will contact him to verify that he intends to proceed with the purchase by applying the correct price. In case of confirmation in this sense, the Customer is requested to remember that this does not however imply any obligation on the part of Cicala to provide the service(s). The prices indicated on the Cicala website at check-out include all taxes (including VAT) due on the purchase of services. The payment of the service(s) must be made by credit or debit card, advance bank transfer. Cicala accepts payments by Visa, MasterCard, American Express and Maestro cards. If Cicala is not able to accept the Customer's order for any reason, he reserves the right to choose whether to refuse the amount of the debit or credit card or to refund the sums paid with reference to the Customer's order.

4.1 Payments and prices of the Quotation Services

Payment of the services Jewelry repair quotation (point F) and Watches repair quotation (point G) takes place at the time of purchase on the site. It includes the study of the intervention to be carried out, as well as the costs for the collection of the object from the Customer as well as the costs of returning the repaired jewel to the Purchaser's home. The processing (repair) of the jewel, if possible, is not included in the price of the service.

Art. 5 - BEGINNING OF WORKS, DURATION AND LIABILITY

The beginning of the works is agreed between Cicala Jewelry and the Customer, following the signing of the online contract. Following the order, the Customer Service will make contact with the buyer in order to collect all the useful and necessary elements to be able to proceed with the realization of the requested work and start the execution of the work. In the event of failure by the Customer to cooperate, Articles 1206 ss c.c. and no responsibility can be attributed to Cicala Jewelry for the delay or lack of performance. In the cases referred to in the previous period, the price paid for the provision of the Service will be withheld by Cicala Jewelry as consideration for the resources of time and materials used by the professional to meet the request not completed. The duration of the works is agreed with the Customer, after having collected all the information useful for his determination, having regard to the complexity of the work to be performed.

5.1 Obligations of the Consultant and the Client (point E)

With the assumption of the assignment for the jewelry consulting service the Consultant undertakes to remain his own work using the diligence required by the nature of the activity carried out. The Customer has the obligation to make aware and to promptly send to the Consultant all the documentation and information necessary for carrying out the assignment.

5.2 Timing of realization of the jewelry repair quotation (point F)

The quotation is generally sent to the customer in about 10 working days. However, the timing may vary, even significantly, depending on the complexity of the jewel. Any delays with respect to the term agreed between the parties will be communicated as soon as possible to the Customer indicating a new deadline within which the quotation will be sent. This new term, if not accepted by the customer, must be communicated at the latest within 24 hours of receipt of the communication from the Cicala Jewelry.

5.2.1 Duration of the quotation

The quotation is valid for 7 days from the date it was sent to the Customer by Cicala Jewelry.

5.3 Timing of the realization of the watch repair quotation (Point G)

The quotation is generally sent to the customer in about 15 working days. However, the timing may undergo variations, even significant ones, depending on the complexity of the watch and the timeliness of the replies from the watchmaking Maison due to the availability of the original components necessary for the repair. Any delays with respect to the term agreed between the parties will be communicated as soon as possible to the Customer indicating a new deadline within which the quotation will be sent. This new term, if not accepted by the customer, must be communicated at the latest within 24 hours of receipt of the communication from the Cicala Jewelry.

5.3.1 Duration of the quotation

The quotation is valid for 7 days from the date it was sent to the Customer by Cicala Jewelry.

5.4 Timing of realization of the design and prototyping service (point H)

Following the order, the Customer Service will make contact with the buyer in order to collect all the useful and necessary elements to be able to proceed with the realization of the requested work and begin execution of the work. In the event of failure by the Customer to cooperate, Articles 1206 ss c.c. and no responsibility can be attributed to Cicala Jewelry for the delay or lack of performance. In the cases referred to in the previous period, the price paid for the provision of the Service will be withheld by Cicala Jewelry as consideration for the resources of time and materials used by the professional to meet the request not completed.

5.4.1 Duration of the work of design and prototyping service

The duration of the work is agreed with the Customer, after having collected all the information useful for its determination, having regard to the complexity of the work to be performed.

Art. 6 - PROCEDURE FOR THE EXECUTION OF THE SERVICES

The provider of the service undertakes to carry out and complete the work with diligence, professionalism and the rule of art. The Customer can always request updates on the execution and its progress by making a request directly to: support@cicala.it.

6.1 Procedures for the execution of the premium engraving service (point A), of the ring adjustment service (point B), of the service of ring size adjustment and engraving (point C), of the necklaces customization service (point D)

The provider of the service, before starting the execution of the work, sends the customer a detailed e-mail and / or a graphic draft of the work ordered. Only after collecting the client's consent to the continuation of the work, will Cicala start the commissioned works.

6.2 Procedures for the execution of the design and prototyping service (point H)

provider of the service, with this service, undertakes to carry out the graphic prototype of the product requested by the customer. The service does not include the creation of the jewel, or the real goldsmith intervention, which must be regulated and purchased with a separate contract. The customer can always ask for updates by writing directly to: support@cicala.it.

Art. 7 - MODIFICATIONS IN PROGRESS

The Provider of the service undertakes to promptly communicate in advance to the Customer the additional works that during the execution should become necessary for the correct execution of the work with respect to those planned, as described in points A, B, C, D, E, F, G, H (Subject of the contract) of these General Terms and Conditions of work performance (Service).
The communication, including the cost of new works and any new delivery date, must be expressly accepted in writing by the Customer. If the Customer accepts the new conditions, they will have faith in the Cicala Jewelry in derogation of the original agreement on price and object of the work.

Art. 8 - ACCEPTANCE OF THE WORK AND DIFFERENCE

Once the work is finished, following the collection at the store or the delivery, the Customer will have to proceed to the verification of the same in order to carry out the acceptance or to detect any flaws or discrepancies with respect to what he has seen and accepted at the beginning of the works.
The express or tacit acceptance of the work by the Customer frees the lender from liability for differences or defects if these were known to the Customer or if they could be easily recognized, provided they were not maliciously concealed.
The Client must, under penalty of forfeiture, report the differences and defects to Cicala Jewels within eight days of discovery by registered letter or by electronic communication sent to: support@cicala.it.

These conditions (6. Acceptance of the work and discrepancies) are not applicable to services E (jewelry consultancy), F (Jewelry repair quotation), G (Watches repair quotation), H (design and prototyping) of this contract

Art. 9 - EXCLUSION OF THE RIGHT OF WITHDRAWAL OF THE CUSTOMER FROM THE CONTRACT

According to the art. 59 of the Consumer Code, the supply of work for the realization of products on request does not make the regulation on the right of withdrawal applicable.

Art. 10 - IMPOSSIBILITY OF THE EXECUTION OF THE WORK

If the execution of the work becomes impossible due to reasons not attributable to any of the parties, the Cicala Jewels is entitled to compensation for the work performed in relation to the usefulness of the part of the work completed. This amount is evaluated from time to time at the discretion of the parties.

Art. 11 - COMPLAINTS

Any complaints must be sent by registered letter with return receipt. to Cicala and anticipated, if possible, by e-mail to the address cicala@cicala.it with the subject: "Claim" followed by the purchase order number.

Art. 12 – DISPUTES

Any dispute between the parties regarding this contract will be settled by the court in whose district the consumer, the law in force, is domiciled or resident, provided that the place is located within the Italian Republic. For disputes outside the Italian State will be settled by the Court of Genoa.

Art. 13 - FINAL CLAUSES

These Terms of Service and any other document expressly referred to herein constitute the entire agreement between the parties with reference to the subject of the Contract. The Contract and any further communication between the parties will be formulated in Italian. The form, existence, construction, execution, validity and any other aspect of these Terms of Service or any of the clauses contained therein are governed by Italian law.
